Section 504 of the Rehabilitation Act of 1973 is a federal statute that provides that "no otherwise
qualified individual with a disability ... shall, solely by reason of his or her disability, be excluded from
the participation in, be denied the benefits of, or be subjected to discrimination under any program or
activity receiving Federal financial assistance." Under Section 504, an "individual with a disability"
is a person (1) who has a physical or mental impairment (2) which substantially limits (3) one or more
major life activities of such individual. Section 504 also protects from disability discrimination those
individuals who have a record of an impairment or who are regarded as having an impairment.
